Dispute Resolution—Adjudication and Mediation

Disputes inevitably arise, even on the best planned and well executed projects. It is in the interests of all parties to resolve disputes efficiently and effectively. Arbitration and litigation can be very expensive and time consuming, it often takes years for a matter to be determined. This has created a need within the infrastructure world for quicker and more accessible dispute resolution procedures to keep projects and cash flows moving positively.

During the webinar we will discuss the evolution and application of mediation and adjudication from both Ontario and international perspectives. We will compare and contrast the two procedures and consider their benefits and disadvantages. We will also provide an insight into using the FIDIC Dispute Adjudication Board process through a case study of a live project. The webinar will conclude with an overview of how dispute resolution procedures are continuing to develop and adapt.

Our focus throughout will be on the practicalities of resolving disputes.

Meet Our Speakers:

Rebecca Redhead heads Systech Law’s Asia Pacific team and is based in Japan. She is an English qualified Barrister with 20 years’ UK and international experience providing practical, commercially focused legal advice on contentious and non-contentious matters, principally on construction and engineering projects including rail, energy, petrochemicals and infrastructure. She has worked mainly in Europe and Asia and has provided in-house legal and commercial support to a leading Japanese contractor; Japanese consortia and a French engineering contractor.

Susanna Truong is a qualified Solicitor in England and Wales, with 8 years’ international experience specialising in various forms of alternative dispute resolution in the construction and engineer industries. She has worked on numerous high value international projects in UAE, Singapore, Qatar and South Africa. Susanna has a masters’ degree in Construction Law and Arbitration and is a Fellow of the Chartered Institute of Arbitrators.
